Terms of Service

These terms govern your use of Run4Fun. They are written in plain English on purpose. Using the app means you accept them. If you do not accept them, please do not use the app.

1. Who you are agreeing with

You are agreeing with Stefano Tommesani, based in Spain, the operator of Run4Fun. Throughout this document, "we," "us," and "our" mean the same thing. "You" means the person using the app. Contact: info@run4funapp.com.

2. What Run4Fun is

Run4Fun is a multiplayer running game for Android. You and other players capture hexagonal zones on a map by physically running through them. The player or team with the most captured zones at the end of a match wins. The app uses your phone GPS to know which hexagons you have crossed.

The app is provided free of charge at launch. We may introduce paid features in the future; if we do, we will update these terms and notify you in the app before any payment is requested.

3. Who can use it

You must be at least 16 years old to use Run4Fun. By signing in, you confirm that you are.

You also need a valid Google account, since sign-in is handled by Google.

4. Your account

Signing in with Google creates an account in Run4Fun linked to your Google identity. You are responsible for keeping your Google account secure. If your Google account is compromised, your Run4Fun account is also compromised.

You can delete your Run4Fun account at any time from inside the app at Profile → Delete Account. Deletion is permanent and irreversible: there is no soft delete, no grace period, and no backup we can restore from. Your profile, career totals, rating, streak, past matches and every record tying you to them are wiped, and we have no technical way to bring them back even if you ask us to. 5. Running safely is your responsibility

This is the most important section. Please read it.

Run4Fun is a game played by running outdoors. Running outdoors involves real-world risks: traffic, uneven ground, weather, fatigue, other people. You are responsible for your own safety at all times.

  • Watch where you are going. Do not stare at your phone while running. The app is designed to be played with your ears (audio coach) so you do not have to.
  • Obey traffic laws. Do not run into roads, do not cross at unsafe places, do not trespass on private property to capture zones.
  • Know your fitness. Do not push beyond what you can handle. Stop if you feel unwell.
  • Run in places you know to be safe. Choose your play area accordingly.
  • If you have any medical condition that makes running risky, consult a doctor before playing.

The app may show you zones, opponents, or strategic suggestions in places that are not actually safe to run. Always use your own judgment. A zone is never worth running into traffic for.

6. Acceptable use

When using Run4Fun, you agree not to:

  • Cheat or manipulate the game (GPS spoofing, modified clients, bots, etc.)
  • Harass, threaten, or harm other players
  • Use the app for any illegal purpose
  • Reverse-engineer, decompile, or attempt to extract source code from the app
  • Use the app in ways that interfere with our servers (load testing, denial of service, mass automated requests)
  • Impersonate someone else
  • Use a display name that is offensive, deceptive, or violates someone else's intellectual property

We may suspend or terminate accounts that violate these rules. In serious cases (cheating, harassment, illegal activity) we will terminate without prior notice. We will tell you why if we do.

7. Your display name and content

The only "content" you provide to Run4Fun is your display name (taken from your Google account) and your gameplay actions (which hexagons you crossed). You retain ownership of your display name. By using the app, you grant us a license to display your name to other players in matches you participate in — for as long as you have an account and the relevant match records exist.

8. Our intellectual property

The Run4Fun app, name, logo, design, mechanics, code, and visuals are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

The H3 hexagonal grid system is open source, used under its public license. Google Maps tiles are provided by Google under their terms. Open source libraries used in the app are listed in the app credits.

9. Changes to the service or these terms

We may change the app, add features, remove features, or stop offering the service entirely. We will notify you of material changes in the app or via email.

We may change these terms. If we change them in a way that materially affects you, we will notify you in the app at least 14 days before the changes take effect, so you have time to review them and stop using the app if you do not agree.

10. Ending this agreement

You can stop using Run4Fun at any time and delete your account inside the app.

We can terminate your account if you materially breach these terms. If we do, we will tell you why and let you export your data first, except in serious cases (cheating, harassment, fraud, illegal activity) where we will terminate immediately.

11. No warranty

Run4Fun is provided "as is." We do our best to make it work well, but we do not guarantee it will be uninterrupted, bug-free, or always available. GPS is imperfect, networks fail, batteries die. The game depends on factors beyond our control.

To the maximum extent permitted by law, we disclaim all implied warranties — merchantability, fitness for a particular purpose, non-infringement, and so on.

This section does not exclude or limit any rights you have under mandatory consumer protection laws in your country, including those provided by Spanish and EU consumer law.

12. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, consequential, or special damages arising from your use of Run4Fun — including lost profits, lost data, or personal injury sustained while running (see Section 5).

Our total liability for any claim related to Run4Fun is limited to the amount you paid us in the 12 months preceding the claim, which at launch is zero euros.

Nothing in this section limits liability that cannot be limited under applicable law — including liability for fraud, gross negligence, or harm caused intentionally.

13. Indemnity

You agree to indemnify us against claims arising from your misuse of the app, your violation of these terms, or your violation of someone else's rights. This section does not apply where it would be unenforceable under Spanish or EU consumer law.

14. Governing law and disputes

These terms are governed by the laws of Spain.

If you are a consumer resident in the European Union, you also have the protections of the mandatory consumer protection laws of your country of residence. You can bring legal proceedings in the courts of your country of residence, or in the courts of Spain.

If you have a complaint, please contact us first at info@run4funapp.com. We will do our best to resolve the matter directly. EU consumers can also use the EU Online Dispute Resolution platform.

15. Other terms

  • Entire agreement. These terms, together with the Privacy Policy, are the entire agreement between us about the app.
  • Severability. If a court finds any part of these terms unenforceable, the rest stays in force.
  • No waiver. If we do not enforce a right immediately, that does not mean we have given it up.
  • Assignment. You cannot transfer your rights under these terms without our written permission. We may transfer ours if we sell or restructure the business, with notice to you.
  • Language. These terms are written in English. If we provide a translation in another language and there is any inconsistency, the English version prevails for legal interpretation, except where local law requires otherwise.
